gl.getParameter(gl.DEPTH_BITS) with the frontbuffer will return 99.3% of the time 24-bits, and 0.7% of the time 16 (http://webglstats.com/) regardless of context creation setting of stencil or alpha.

I am completely failing to understand what “frontbuffer” you are talking about. Double buffering, and therefore the concept of front and back buffers only applies to the color buffers.
